How long do I have to file a personal injury claim in Texas?+
Texas has a two-year statute of limitations for most personal injury claims, measured from the date of the accident. There are limited exceptions — for example, cases involving government entities may have shorter deadlines. Missing the deadline means losing your right to recover. Do not wait — contact us as soon as possible after an accident.
What if I was partially at fault for the accident?+
Texas follows the modified comparative fault rule. You can still recover damages as long as you are less than 51% responsible for the accident. Your recovery is reduced by your percentage of fault. For example, if you were 20% at fault and your damages total $100,000, you can recover $80,000. Insurance companies often try to inflate your fault percentage to reduce their payout — we fight that tactic aggressively.
How much is my personal injury case worth?+
Every case is different. Case value depends on the severity of your injuries, your total medical bills, lost wages, the strength of the liability evidence, the defendant's insurance coverage, and several other factors. Should I talk to the other driver's insurance company?+
No. Do not give a recorded statement to the opposing insurance company and do not sign any releases without speaking to an attorney first. Insurance adjusters are trained to minimize your claim. How long does a personal injury case take?+
It depends on the complexity of the case and whether it settles or goes to trial. Many straightforward cases settle within 6–12 months after treatment is complete. Complex cases or those that proceed to trial can take 2–3 years. We move cases as quickly as possible without compromising the value of your claim — settling too early before your injuries are fully documented often means leaving significant money on the table.
What does the attorney fee look like on a contingency case?+
Our standard contingency fee is one-third (33.33%) of the recovery if the case settles before filing suit, 40% if suit is filed, and 45% if the case goes to trial. These percentages are standard in Texas personal injury practice and are disclosed in your representation agreement. You pay nothing upfront and owe nothing if there is no recovery.
